Member of the State Bar of Georgia since 1984.

Education

Juris Doctorate Degree from the University of Georgia School of Law in 1984.

Bachelor of Arts Degree with Honors and a double major in Political Science and Economics from the University of Georgia in 1981. GPA of 3.68.  Phi Beta Kappa National Honor Society, Phi Kappa Phi National Honor Society, and Golden Key National

Honor Society.  I completed my four year degree program in three years (11 quarters) from Fall of 1978 to Summer of 1981.

Graduated with Honors from the Robert L. Osborne High School, Class of 1978.  Marietta, Cobb County, Georgia.

Training

20 Hour General Mediation Training Course conducted by the American Arbitration Association in February of 1994.

General Mediator Practicum conducted by the American Arbitration Association in April of 1994.

Experience

I have enjoyed an active and diverse general civil law practice since June of 1984.

From 1984 to 1992 I worked with Wm. Thomas Craig, who was the County Attorney for Newton County, Georgia.  I have been a solo practitioner with my office in the City of Watkinsville, Oconee County, Georgia since July of 1992.

I participated in the Western Judicial Circuit's Court Annexed ADR program as a Mediator from its inception in November of 1994 until 1998, handling both domestic and general civil cases.  (Athens-Clarke and Oconee Counties).

I am registered to provide mediation and arbitration services for the United States District Court, Middle District of Georgia.

Courts

I am authorized to handle matters in all Magistrate, State and Superior Courts of the State of Georgia, and primarily practice in Oconee, Clarke, Jackson, Barrow, Walton, Madison, Morgan, Greene and Oglethorpe Counties.

I handle appellate matters in the Georgia Court of Appeals and the Georgia Supreme Court.

I am authorized to handle matters in the United States Bankruptcy Courts for the Middle and Northern Districts of Georgia, and primarily practice in the Athens and Gainesville Divisions.

I am authorized to handle matters in the United States District Courts for the Middle and Northern Districts of Georgia.

I am authorized to handle appeals to the United States Court of Appeals for the 11th Circuit.

I have not as yet enjoyed the opportunity to appear before the United States Supreme Court.

Areas

My practice primarily focuses on matters related to various aspects of owning and operating a business, including the following specific areas listed alphabetically, not by degree of concentration.

Appeals

I handled the appeals of the following cases, and assisted in several others wherein I was not the lead counsel:

1.      State Soil & Water Conservation Comm'n v. Stricklett, 252 Ga. App. 430, 555 S.E.2d 800 (2001).

2.      Cecil T. Allgood, Inc. v. Stark Props., Inc., 244 Ga. App. 105, 534 S.E.2d 858 (2000).

3.      MTW Inv. Co. v. Alcovy Props., 228 Ga. App. 206, 491 S.E.2d 460 (1997).

4.      MTW Inv. Co. v. Alcovy Props., 223 Ga. App. 230, 477 S.E.2d 395 (1996).

5.      Farmers State Bank v. Huguenin, 220 Ga. App. 657, 469 S.E.2d 34 (1996).

6.      Alcovy Properties v. MTW Inv. Co., 212 Ga. App. 102, 441 S.E.2d 288 (1994).

7.      MTW Inv. Co. v. Vanguard Properties Fin. Corp., 349 S.E.2d 390 (1986).  1986 Ga. LEXIS 872.

Bankruptcy

I have extensive experience representing creditors in bankruptcy cases, including banks, landlords, land developers, businesses and individuals.  I only represent the creditor’s side.  I assist with filing proof of claims, motions to lift the stay, and objections to discharge.

Business

I have extensive experience representing small businesses including a wide range of business issues such as formation, general liability, contract negotiations or disputes, employee issues, shareholder issues, sales of businesses, and leases.

Construction

I handle construction disputes from all sides.  I file materialman liens on behalf of subcontractors and suppliers. I represent general contractors and property owners with various types of disputes.

Credit

I work extensively in the area of credit, including creation of credit applications for retail businesses, collection of accounts, individual financing arrangements, and installment purchase contracts.

Estates

I prepare simple last wills and testaments, financial and health care powers of attorney, and assist in the transfer of assets or creation of trusts where the client has specific objectives.

Litigation

While the great majority of my work does not involve courtroom activity, I do handle an occasional litigation matter.  Most recently:

I won a jury verdict for the highest amount of nominal damages ($625,000.00) ever recorded in reported Georgia cases. 

I won a tax appeal in Hall County, Georgia, where the jury adopted my client’s opinion of value and ordered Hall County to pay my attorney’s fees.

I prevented the Broad River Soil and Water Authority from compelling my clients to remove their home which inadvertenly encroached upon a flood easement.

I assisted a consumer to recover money from a used car dealer who used unfair business practices.

I assisted a consumer to recover money from a bank which allowed a dishonest builder to swindle money through fraudulent practices.

I represented at various times contractors, subcontractors, and home owners with disputes over construction quality or completion, and payment.

Non-Profits

I represent several non-profit organizations, including churchs, and assisted in acquiring § 501(c)(3) exemption recognition.

Real Estate

I have extensive experience in real estate matters including title examination, correcting title defects, boundary line disputes, closing both real property sales and loans, tax sales and redemption, foreclosure sales and confirmations, condemnation and inverse condemnation, and acquisitions for local county water, sewer or road easements.  My time working on land acquisition for Newton County projects provided abundant experience in title searching and dealing with title issues such as family land which has passed through several generations without benefit of any deeds or affidavits.

Excluded

I work exclusively in the civil area of law, with a primary concentration on business related matters as described above.  I seldom handle divorce, child custody or other domestic relations matters with the exception of collection of child support or similar financial obligations.  I do not handle highly specialized legal matters such as tax or extensive estate planning.  I do not handle criminal matters of any nature.
